How to Avoid an Employee Lawsuit

Top ten policies that will guarantee you lose in an employment lawsuit:

  1. Fire all employees over the age of 40 to have a younger and hipper look in the office for your patients.
  2. Fire anyone at anytime because all my employees are “at-will.”
  3. Don’t address infractions and improper work practice until you are firing the employee.
  4. Pay no one overtime because they are all exempt under the law.
  5. Show nepotism. Do not be consistent in the hiring, discipline and firing practices because no one will catch on to it.
  6. Be quick to terminate employees who obviously have health problems.
  7. Write nothing down because they will use it against me. Besides, a jury will believe me, the doctor, over the employee.
  8. I do not have to worry about discrimination or harassment suit because my handbook has an equal employment policy in it somewhere.
  9. I do not need an employee handbook because I am a small office and we’re going to handle under a “family style business.”
  10. I terminated that employee for “cause” so I can tell all the other doctors offices about what the employee did.
